These Terms of Service govern access to and use of Drophero, including Drophero.app, the Drophero web application, Drophero Shopify app functionality, optional Chrome Extension functionality, and related support services.

Drophero is operated by Drophero, registered in the Netherlands with the Dutch Chamber of Commerce. We do not publish the private residential address of the business owner on this website. Where a formal address is legally required by a competent authority, platform reviewer, payment provider, or regulator, it can be provided through the appropriate private channel.

1. Introduction

These Terms of Service govern access to and use of Drophero, including Drophero.app, the Drophero web application, Drophero Shopify app functionality, optional Chrome Extension functionality, and related support services.

Drophero is operated by Drophero, registered in the Netherlands with the Dutch Chamber of Commerce. We do not publish the private residential address of the business owner on this website. Where a formal address is legally required by a competent authority, platform reviewer, payment provider, or regulator, it can be provided through the appropriate private channel.

By creating an account, installing the app, connecting a store, connecting an advertising account, or using Drophero, you agree to these Terms. If you do not agree to these Terms, do not use Drophero.

2. The Drophero service

Drophero provides software tools that help merchants create original Shopify-ready product drafts and ad creative drafts from product information they are authorized to use. The service may include AI-assisted product draft creation, content rewriting, translation, product review screens, Shopify product publishing, Meta/Facebook advertising workflows, workflow history, and related dashboard functionality.

Drophero is designed as a merchant-controlled workflow. Users must review, edit, approve, and confirm all generated outputs before publishing them to Shopify, Meta/Facebook, or any other platform.

Drophero does not guarantee that any product, advertisement, campaign, creative, or AI-generated output will generate sales, profit, traffic, approval by any platform, or any particular business result.

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use Drophero. You must provide accurate account information and keep your login credentials secure.

You are responsible for all activity that occurs under your account, connected Shopify store, connected Meta/Facebook account, Chrome Extension session, or other connected integration. You must notify us promptly if you believe your account has been accessed without authorization.

4. Authorized product sources and user content rights

Drophero may only be used with product information, URLs, media, advertising references, and other materials that you are allowed to use. You may only submit, reference, generate from, publish, or otherwise use:

  • Your own product information and your own URLs or sources.
  • Product information, media, or sources that you are licensed to use.
  • Officially licensed product sources.
  • Dropshipping product sources that you are authorized to sell or promote.
  • Third-party sources only when you have permission from the relevant rights holder or company.

Public ads, competitor pages, product pages, or other third-party references may only be used as creative inspiration for structure, hooks, benefits, formatting, positioning, or ideas. You may not use Drophero to copy third-party product text, images, videos, logos, trademarks, brand assets, or other protected content verbatim without permission.

Before publishing, you must confirm that you own, are licensed to use, or are authorized to use the product information, media, URLs, references, and sources used in your workflow. Drophero may store the source URL, user or shop identifier, timestamp, and rights-confirmation status for compliance, support, and audit purposes.

You remain fully responsible for the legality, accuracy, rights clearance, product claims, advertising claims, translations, media choices, pricing, availability, and platform compliance of any content you submit, generate, approve, or publish through Drophero.

5. AI-generated drafts and review responsibility

Drophero may use AI systems to rewrite, translate, summarize, structure, generate, or improve product and advertising content. AI outputs are drafts only. They may be incomplete, inaccurate, unsuitable, or require human review.

You must review and approve all AI-generated outputs before using or publishing them. You are responsible for checking product facts, medical or health claims, pricing, warranties, shipping claims, intellectual property rights, advertising policy compliance, and any legal or regulatory requirements that apply to your business.

Drophero does not provide legal, tax, accounting, intellectual property, platform policy, or advertising compliance advice. You should seek professional advice where needed.

6. Shopify integration and product publishing

If you install or use Drophero through Shopify, you authorize Drophero to access and process the Shopify data and permissions needed to operate the app and perform the actions you request, such as creating or publishing approved product drafts.

Shopify product publishing must be initiated or approved by the merchant through the app workflow. Drophero should not publish unapproved product information without merchant action or confirmation.

For the Shopify App Store flow, publishing approved product drafts to Shopify is not intended to require Paddle, an external checkout flow, or an external payment provider. If paid app features are offered inside the Shopify app to Shopify App Store users, they must be handled through Shopify Billing or Shopify App Pricing, unless Shopify expressly permits another method.

Uninstalling Drophero from Shopify may revoke access and stop future Shopify actions. Some records may be retained for legal, security, troubleshooting, billing, or compliance reasons as described in the Privacy Policy.

7. Meta/Facebook and advertising integrations

If you connect Meta/Facebook or another advertising platform, you authorize Drophero to access and process the account, page, campaign, ad set, ad, creative, and performance data needed to provide the features you enable.

You are responsible for ensuring that all ads, creatives, claims, targeting, budgets, pages, products, and campaigns comply with applicable laws and the policies of Meta/Facebook or any other connected platform. Drophero does not guarantee ad approval or performance.

You may disconnect advertising integrations where this functionality is available. Disconnecting an integration may stop future actions but may not remove historical workflow records that are retained for legitimate operational, compliance, or legal reasons.

8. Optional Chrome Extension

The Drophero Chrome Extension is optional. The Shopify app flow should not require the Chrome Extension unless clearly disclosed for a separate optional feature.

If you use the Chrome Extension, you must only send your own URLs, authorized product sources, licensed material, or public material used as creative inspiration only. The extension must not be used to copy third-party content without permission.

9. Billing, plans, credits, and cancellation

Drophero may offer free, trial, paid, credit-based, or usage-based features. The available plans, pricing, usage limits, credits, drops, and included features are shown in the app, pricing page, Shopify listing, or other relevant checkout or billing screens.

For Shopify App Store users, paid app features made available inside the Shopify app are handled through Shopify Billing or Shopify App Pricing where required by Shopify. Shopify users should not be routed to Paddle or another external checkout for paid Shopify app features unless Shopify expressly permits it.

Credits, drops, or usage allowances may apply to AI generation, ad creative workflows, or other paid features where clearly shown. Publishing approved product drafts to Shopify should remain separate from external checkout flows and should not be conditioned on Paddle status for Shopify App Store users.

You may cancel according to the cancellation options available in your account, Shopify Admin, or the applicable billing platform. Refunds, if any, are governed by the Drophero Refund Policy and the rules of the applicable billing provider, including Shopify Billing or Shopify App Pricing for Shopify App Store users.

Drophero may update its pricing, plan structure, or feature availability prospectively. If the Shopify app or Shopify publishing functionality is offered free of charge in the future, no app charge will be collected for those free Shopify app features. Any paid features made available inside the Shopify app will continue to follow Shopify-approved billing requirements unless Shopify expressly permits another method.

10. Acceptable use

You agree not to use Drophero to:

  • Violate any law, regulation, platform policy, intellectual property right, privacy right, publicity right, or contractual obligation.
  • Copy, scrape, import, publish, or distribute third-party product content, images, videos, logos, trademarks, or brand assets without permission.
  • Create misleading, deceptive, fraudulent, unsafe, illegal, or harmful products, ads, claims, or campaigns.
  • Interfere with, disrupt, reverse engineer, attack, overload, or attempt to gain unauthorized access to Drophero or any connected service.
  • Upload malware, malicious code, unlawful content, or content that infringes the rights of others.
  • Misrepresent your identity, permissions, product rights, business relationship, or authorization to use any source or content.
  • Use Drophero to send spam, violate advertising policies, or engage in abusive automation.

We may suspend or terminate access if we reasonably believe your use violates these Terms, creates legal or platform risk, harms Drophero or another party, or may result in abuse, infringement, security issues, or policy violations.

11. User content license

You retain ownership of the content you submit to Drophero, subject to any rights owned by third parties. By submitting content, URLs, product information, media, or other materials, you grant Drophero a limited license to host, process, transmit, analyze, transform, generate drafts from, and display that content only as needed to provide, secure, support, and improve the service and as described in the Privacy Policy.

You represent and warrant that you have all rights, licenses, permissions, and authorizations needed to submit the content and to allow Drophero to process it for the purposes of the service.

12. Drophero intellectual property

Drophero, including its software, workflows, interface, designs, brand, documentation, code, systems, templates, and service features, is owned by Drophero or its licensors and is protected by intellectual property and other laws.

These Terms do not transfer any ownership rights in Drophero to you. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Drophero except as permitted by law or expressly authorized in writing.

13. Third-party services

Drophero may integrate with or depend on third-party services such as Shopify, Meta/Facebook, AI providers, hosting providers, analytics tools, email providers, billing providers, automation tools, storage providers, and browser extension platforms.

Your use of third-party services may be subject to their own terms, privacy policies, permissions, platform rules, and billing rules. Drophero is not responsible for third-party service outages, policy changes, rejected ads, rejected app actions, billing decisions, account restrictions, or integration limitations outside Drophero's control.

14. Availability and changes to the service

We aim to keep Drophero reliable, but we do not guarantee uninterrupted or error-free availability. Features may be changed, added, limited, suspended, or removed over time for operational, legal, security, platform, or business reasons.

We may perform maintenance or updates that temporarily affect availability. We may also limit or suspend features where needed to comply with laws, platform requirements, security obligations, or third-party service limitations.

15. Disclaimer of warranties

Drophero is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, secure, or suitable for every business purpose.

We do not guarantee product approval, Shopify approval, Meta/Facebook ad approval, advertising results, product sales, revenue, profit, accuracy of AI outputs, or compliance with every law or platform policy. Users must review and verify all outputs before use.

16. Limitation of liability

To the maximum extent permitted by applicable law, Drophero will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, goodwill, data, business opportunity, advertising spend, or expected savings.

To the maximum extent permitted by applicable law, Drophero's total liability for any claim relating to the service will be limited to the amount paid by you to Drophero for the service during the three months before the event giving rise to the claim, or EUR 100 if no amount was paid, unless a higher amount is required by mandatory law.

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Drophero from claims, damages, liabilities, costs, and expenses arising from your use of the service, your content, your products, your ads, your connected accounts, your breach of these Terms, your infringement of third-party rights, or your violation of law or platform policies.

18. Suspension and termination

You may stop using Drophero at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, create legal or platform risk, misuse the service, infringe third-party rights, or threaten the security or reliability of the service.

After termination or uninstall, some data may be deleted, anonymized, retained, or made inaccessible according to the Privacy Policy, applicable law, platform requirements, and operational retention rules.

19. Privacy

Your use of Drophero is also governed by the Drophero Privacy Policy. The Privacy Policy explains how we collect, use, store, share, and delete personal data and connected platform data.

20. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date and, where appropriate, notify users through the service or by email. Continued use of Drophero after changes become effective means you accept the updated Terms.

21. Governing law and disputes

These Terms are governed by the laws of the Netherlands, unless mandatory consumer or local law provides otherwise. Any dispute relating to these Terms or Drophero will be submitted to the competent courts in the Netherlands, unless mandatory law requires another forum.
